Terms of Service

These Terms of Service ("Terms") govern your use of newsence (the "Service"), operated by newsence ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms.

This document is a working draft and not a substitute for legal advice. If you are using newsence in a professional or commercial context, please consult a qualified attorney for your jurisdiction.

1. The Service

newsence is a personal knowledge base and content discovery platform. It aggregates content from sources you connect (RSS, Hacker News, Twitter, YouTube, and others), uses AI to summarise, translate, and cross-reference that content, and lets you save, organise, search, and create from what you keep.

2. Eligibility and accounts

You must be at least 13 years old (16 in jurisdictions where applicable) to use newsence. By creating an account, you confirm that you meet this requirement and that the information you provide is accurate.

You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorised access.

3. Acceptable use

When using newsence, you agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law
  • Upload, save, or share content that is illegal, infringing, defamatory, harassing, or hateful
  • Attempt to gain unauthorised access to other accounts, systems, or data
  • Interfere with or disrupt the Service, including by introducing malware, denial-of-service attacks, or automated abuse (e.g. mass-scraping the Service itself)
  • Reverse engineer, decompile, or attempt to extract source code or model weights
  • Resell or sublicense the Service without our written consent
  • Use the Service to spam, deceive, or impersonate others

4. Your content

You retain ownership of content you save or create in newsence ("Your Content"). By saving or creating content, you grant newsence a non-exclusive, worldwide, royalty-free licence to host, store, process, transmit, display, and create derivative works (such as AI summaries and embeddings) from Your Content solely for the purpose of operating and improving the Service.

You are responsible for ensuring that you have the necessary rights to any content you upload or save, and that your use does not violate copyright, trademark, or other intellectual property rights of others.

5. Third-party content

newsence aggregates publicly available content from external sources (websites, RSS feeds, public social media, video transcripts). We do not claim ownership of this content; copyright remains with the original publishers. AI summaries and translations of third-party content are provided for personal use under fair use principles. If you are a content owner and would like your material removed, please contact us.

6. AI features

newsence uses artificial intelligence to generate summaries, translations, embeddings, semantic search results, and chat responses. AI output is provided "as is" and may contain inaccuracies, omissions, or hallucinations. You should not rely on AI-generated content for medical, legal, financial, or other professional decisions without independent verification.

7. Subscriptions and billing

newsence offers free and paid subscription plans. Paid plans are billed monthly through Polar, our payment processor. By subscribing, you authorise recurring charges until you cancel. You can cancel at any time from your account settings; cancellation takes effect at the end of the current billing period and you will not be refunded for unused time except where required by law.

We may change pricing with at least 30 days' notice. Your continued use after the change means you accept the new pricing.

8. Termination

You may delete your account at any time. We may suspend or terminate your account if you violate these Terms, fail to pay subscription fees, or use the Service in a way that harms newsence or other users. Upon termination, your right to access the Service ends; we will retain or delete data in accordance with our Privacy Policy.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF AI-GENERATED CONTENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, newsence SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold newsence harmless from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your infringement of any rights of a third party.

12. Governing law

These Terms are governed by the laws of Taiwan (Republic of China), without regard to conflict-of-law principles. Any disputes shall be resolved in the courts of Taipei, Taiwan, except where applicable consumer protection law gives you the right to bring proceedings elsewhere.

13. Changes to these Terms

We may update these Terms from time to time. For material changes, we will notify you by email or in-product notice at least 30 days before the change takes effect. Continued use of the Service after the effective date means you accept the new Terms.
